INFORMATION TEXT ON THE PROTECTION AND PROCESSING OF PERSONAL DATA
The Personal Data Protection Law (hereinafter referred to as "KVKK") was published in the Official Gazette on April 7, 2016, and has come into effect.
Under this law, as Sesa Elektronik Sanayi ve Ticaret Anonim Şirketi (hereinafter referred to as the "Company"), we place great importance on the security and privacy of your personal data and strive to implement the highest level of security measures to process and protect this data. We process your personal data in the context described below, in accordance with KVKK and relevant legal regulations, as the data controller.
The Information Text on the Processing of Personal Data (the "Information Text") has been prepared to transparently inform you about the identity of the data controller, the method and legal reason for collecting your personal data, the purposes for processing this data, to whom and for what purposes it may be transferred, the duration of data processing, and your rights as outlined in Article 11 of KVKK. This information text also covers sensitive personal data.
- DEFINITIONS
- Personal Data: Any information related to an identified or identifiable natural person.
- Personal Data Protection Law ("KVKK"): Law No. 6698 on the Protection of Personal Data, which was published in the Official Gazette on April 7, 2016.
- Data Processor: A real or legal person who processes personal data on behalf of the data controller based on the authority given.
- Data Controller: The real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
- IDENTITY OF THE DATA CONTROLLER
According to KVKK, the "Data Controller" refers to the real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system. - METHOD AND LEGAL BASIS FOR COLLECTING YOUR PERSONAL DATA
Your personal data may vary depending on your relationship with our Company; it can be collected through automatic or non-automatic methods, through our affiliated units, website, social media platforms, phone, email, and other means, or through communications with doctors or other hospital personnel during medical tests, examinations, and measurements conducted at partner hospitals. Your personal data can be collected electronically via emails and our website. Your personal data may be processed and stored in both digital and physical environments as long as your relationship with our Company continues.
Personal data, including information about your health status, may be processed for the following purposes:
- To determine the appropriate medical device for you, to treat and monitor your medical needs; billing and accounting for medical services;
- To improve and monitor the quality of our services, and to ensure the Company's legal, contractual, and physical security.
- PARTIES TO WHOM PERSONAL DATA IS TRANSFERRED AND PURPOSES OF TRANSFER
Your collected personal data may be transferred in accordance with the basic principles set forth in the Law and under the conditions specified in Articles 8 and 9 of the Law, to doctors or relevant departments of the hospital where you receive treatment, to our business partners, intermediaries providing services to the Company, suppliers, legally authorized public institutions, necessary persons and institutions related to legal proceedings, and authorized real and legal persons.
- YOUR RIGHTS AS A PERSONAL DATA SUBJECT
In accordance with Article 11 of KVKK, you have the following rights regarding your personal data, provided you prove your identity:
- To learn whether the Company processes personal data about you, and if so, to request information about it;
- To learn the purpose of processing your personal data and whether it is used for that purpose;
- To learn whether your personal data is transferred domestically or internationally and to whom it has been transferred.
Additionally, you have the right to request correction of any incorrect or incomplete personal data and to request notification of this correction to the recipients of your data.
You may request the deletion, destruction, or anonymization of your personal data within the framework of the conditions specified in Article 7 of KVKK. You may also request that third parties to whom your data has been transferred be informed about this request for deletion. However, your request will be evaluated to determine the appropriate method of destruction based on the specifics of the case. You may always request information from us about the chosen destruction method.
You may object to the results of an exclusively automated system used to analyze your personal data if the results are contrary to your interests.
If you suffer damage due to unlawful processing of your personal data, you may request compensation for the damage.
Your requests will be resolved free of charge within thirty days, depending on the nature of the request. However, if the processing requires additional costs for the Company, a fee may be charged as per the tariff specified by the Personal Data Protection Board in the Communiqué on the Application Procedures and Principles to the Data Controller.
You must submit your request in writing or via registered electronic mail (KEP), secure electronic signature, mobile signature, or the electronic mail address previously provided and recorded by us. The Company may request additional verification to determine the nature of your request and ensure it is your request.
